• Violate any laws, third party rights, or our policies such as the Prohibited and Restricted Items policies;
• Use the site if you are under the age of 18 or are unable to form legally binding contracts;
• Create or access any profile if you have been temporarily or indefinitely suspended from our site;
• Circumvent or manipulate the billing process, including but not limited to fees owed to Recycle Your Wedding or payments owed to Recycle Your Wedding users;
• Fail to deliver payment owed by you to other members of Recycle Your Wedding for services rendered or merchandise purchased unless your purchase meets the following criteria:
• Seller fails to deliver merchandise
• Condition of merchandise is changed after purchase
• You cannot authenticate the seller’s identity
• Transaction fails to meet purchase guidelines as outlined by Recycle Your Wedding
• Fail to deliver items purchased from you unless your purchase meets the following criteria:
• Buyer fails to meet the posted terms
• Buyer fails to provide payment for service(s) rendered or merchandise provided.
• You cannot authenticate the buyer’s identity
• Post false, misleading, defamatory, or libelous content;
• Distribute or post spam, chain letters, or pyramid schemes;
• Distribute viruses or any other technologies that may harm Recycle Your Wedding, its users, or affiliates;
• Access any Recycle Your Wedding account of which you are not authorized;
• Transfer your User ID or Recycle Your Wedding account without express written consent of Recycle Your Wedding;
• Manipulate the price of any item;
• Interfere with other user’s listings;

Inappropriate Action(s) 

Recycle Your Wedding is committed to providing content to its users that is free of offensive, disruptive, or obscene content.  Any violation of these policies should be reported to us immediately. Copyright and Trademark Infringement is expressly prohibited.  If you encounter any of these infringements, please notify us immediately. We reserve the right to limit, suspend, or terminate our services to any person(s) we believe to be causing problems on our site.  We may revoke the privileges of any user who, through action or intent, impedes the buying or selling process of other users of Recycle Your Wedding, causes potential legal liabilities, or acts against the spirit of our policies.   

We reserve the right to cancel any listing at any time without notice.  We reserve the right to cancel any account that has been inactive for more than 120 days. 

Fees and Services  

Standard membership to Recycle Your Wedding is free!  There are fees for posting and selling items and services.  The Posting Fees and Closing Fees are listed for your review on the Fees tab of this site.  These fees will also be made available for you to review prior to posting your items for sale.  By accepting the Posting Fee, you also accept the Closing Fee that is associated with the total price of your sale. These fees are reviewed from time to time, and could change without notice.  All fees are stated in U.S. Dollars.  You are responsible for paying all applicable fees and taxes associated with your purchase.  Your payment must be made no later than seven days after agreement to purchase merchandise, and must be made using a valid payment method. 

We reserve the right to collect fees owed using various collection methods.  We also reserve the right to seek and retain legal counsel for any monies owed. 

Liability  

Recycle Your Wedding is not responsible for the actions or inactions of others.  We are not involved in the actual transaction between buyers and sellers.  The quantity, quality, or safety of items bought and sold is beyond our control, and thus we cannot and do not guarantee your satisfaction of any items bought or sold.  You will not hold Recycle Your Wedding responsible for the legality of items advertised, the accuracy of items listed, the ability of sellers to sell items, or the ability of buyers to buy an item. 

We are not responsible for any action that leads to a buyer or seller’s inability to complete a transaction. The governing provisions of the Uniform Commercial Code serve to define the following terms:  “ownership”, “transferability”, “contract”, “agreement”, “sale”, “present sale”, “termination”, “cancellation”, “buyer”, “seller”.  This is not an all-inclusive list.  The complete list of terms and definitions can be found in the Uniform Commercial Code. 

Ownership of purchased and/or sold items is not transferred until possession of those items is exchanged.  Payment for items does not constitute ownership. We are not liable for any loss of money, merchandise, reputation, or any other damages arising from transactions that take place on this site.  Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.  

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, photographs, and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.  All trademarks reproduced in this website which are not the property of, or licensed to, the operator must be acknowledged on the website.  Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

Limited Liability 

If we are found to be liable, our liability is limited to the greater of (a) the total fees paid during your transaction, and (b) $200. 

Information Mining, Spamming, and Scraping 

You are prohibited from creating, installing, or activating any robots, scrapers, or other computer programs to access Recycle Your Wedding.  Any use of spam is strictly prohibited, and any person found to be using spam will have their access to the site revoked and may be held legally and financially liable for damages. 

Privacy 

The protection of user privacy is one of our highest priorities.  We will not sell or rent your personal information to third parties for their marketing purposes.  You have the ability to modify or delete your account at any time.   

Indemnity  

You agree to not hold us accountable for any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. Resolution of Disputes  Here at Recycle Your Wedding, we realize that from time to time, disputes may arise.  Our goal is to help to resolve these disputes quickly, fairly, and without bias.  We encourage you to contact us immediately when a dispute arises.   

Claims Process – You agree to follow the claims processed as outlined below.  Note:  Failure to follow this procedure may void your claim.

Your claim should include the following: 

• Your full name
• Your address
• Your email address
• A contact phone number
• A complete description of the incident, item(s) in question, amount(s), and the date of the transaction 

We have up to thirty (30) days to review and resolve the dispute. For any dispute that cannot be resolved through the claims process, both parties agree to seek resolution through binding, non-appearance-based arbitration.  In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. 

Listing Guidelines and Requirements 

We are an online community of buyers and sellers.  In an effort to maintain a cohesive union between those two entities, Recycle Your Wedding has established a set of guidelines and requirements for listing items on its site.  Recycle Your Wedding reserves the right to, at its discretion, adjust, modify, or remove any listing not adhering to the requirements below with or without the knowledge or consent of the seller or buyer. 

Buyer and Seller Guidelines 

All listings must adhere to Recycle Your Wedding’s posting policy requirements which state:

• Pictures of items posted must be of that specific item, and not a representation of a similar item
• Items must be represented fairly and accurately and without deceit
• Seller cannot insert a link into item description that promotes the selling of merchandise or services on other websites
• Seller cannot use misleading titles to misrepresent item being sold
• Seller cannot create a listing to promote giveaways, random drawings, raffles, bonuses, or prizes
• Seller cannot use listing to advertise other auction websites (including but not limited to eBay, Yahoo, MSN, Amazon, Craigslist, etc.)
• Sellers may not describe, list, post, or sell any obscene, offensive, pornographic, illegal, or inappropriate items.  For more information, see Recycle Your Wedding’s list of prohibited items.
• Seller is required to honor the contract put into place when payment is accepted for an items, unless buyer is in violation of any terms outlined in this user agreement.
• Seller may not use wording to provoke or provide the opportunity for item to be purchased outside of Recycle Your Wedding.
• Once item is purchased, Seller is required to ship item within 7 days of purchase.  Failure to ship item may result in suspension of account.  Seller will also be financially and legally responsible for refunding fees, monies, etc.  Failure to refund money may result in criminal charges against the Seller.

• Pricing must not include hidden or additional surcharges
• Pricing must be in U.S. dollars
• Listing cannot be priced for one item, but seller offers multiple identical items in the selling description
• Seller cannot charge excessive shipping fees.  Fees are determined by shipping company, and seller cannot intentionally inflate shipping fees.

• All payments must be made in U.S. dollars
• All payments must be made within seven days of purchase
• Sellers may not require a user to mail cash.  Recycle Your Wedding strongly opposes the mailing of unsecured monies through any means.
• All items must be paid in full.  No partial payments are accepted on this site.
• Payments are to be made to the seller only. 
• No third party payments are accepted.
• Buyer is required to honor the contract put into place once a bid is placed, or an agreement is made to purchase the item through the “buy now” option, unless the seller is in violation of any terms outlined in this user agreement.

Fee Circumvention

It is a violation of Recycle Your Wedding's policies to take any action that attempts to circumvent the paying of fees for services rendered on the site.  Those fees including listing fees, optional listing upgrades, fees for additional photographs, final sale fees, storefront fees, fees for classified ads, etc.  This list is not all inclusive.  Attempts to circumvent the paying of fees may result in cancellation of listing or termination of Recycle Your Wedding account. 

Investigations

The safety and welfare of our members and our visitors is paramount.  As such, we reserve the right at any time to conduct investigations into the legitimacy of items and/or services posted on our site, with or without notice to the seller.  If we determine that a listing contains information that misrepresents the item being sold in any way (size, shape, color, price, authenticity, total of items sold, etc.), we reserve the right to remove the posting with or without notice to the seller.  We also reserve the right to terminate the seller's account, permanently ban the seller from using our site, and/or pursue legal action.

Prohibited and Restricted Items Policies 

All members and visitors of www.recycleyourwedding.com agree to adhere to the following guidelines pertaining to prohibited and restricted items. The selling or trading of the following items is prohibited:

• Ammunition
• Contracts of any kind
• Copyrighted merchandise
• Counterfeit merchandise or counterfeit monies
• Drugs or medicines of any kind (legal or illegal), drug paraphernalia
• Event tickets
• Explosives
• Firearms
• Food
• Gift cards
• Government documents or documents issued by any official local, state, or federal government agency
• Items considered illegal under United States Law
• Livestock or live animals
• Lottery tickets
• Manufacture’s coupons
• Merchandise acquired through illegal means
• Movies containing illegal, sexual, or pornographic content
• Photographs containing illegal, sexual, or pornographic content
• Political pamphlets, information, or paraphernalia
• Prohibited Services
• Real Estate
• Stamps
• Stolen property or property with missing serial numbers
• Tobacco
• Used undergarments of any kind
• Weapons of any kind
• Pornographic images, items, or videos
• Items that depict any race or religion in a disparaging or negative manner

General 

Recycle Your Wedding is located at 120 Bella Rosa Circle Sanford, Florida 32771. 

We may amend this agreement at any time by posting the amended items on this site.  This agreement is binding in all 50 United States and all U.S. Territories. Any amendments made to this agreement will be put into effect thirty (30) days after the updated agreement is posted on the site. 

Should you choose to continue your registration and membership with this site, you knowingly and willfully agree to accept these terms, and agree to abide by all terms and conditions.
